This document regulates the rules for the provision of electronic services via the website competenceprofile.com

Definitions
  1. Administrator - the person responsible for maintaining and managing the Service is Marcin Wasilewicz, Bächerstrasse 63, 8806 Bäch, CHE-288-385-941.
  2. Platform - the online service available at competenceprofile.com, managed by the Administrator.
  3. Services - electronic services provided by the Administrator via the Platform.
  4. User - an adult natural person who uses the Services provided through the Platform.
  5. Terms - this document, available at competenceprofile.com/terms, which governs the legal relationship between the Administrator and the User.
  6. Privacy Policy - a document available at competenceprofile.com/privacy, which contains information about the types of personal data collected and the purposes for which they are used.
  7. Panel - the administrative interface provided to the User upon successful registration, allowing the creation and management of their Profile and Account settings.
  8. Profile - a public page containing IT competencies selected and rated by the User.
  9. Account - a set of data and rights assigned to the User in connection with the use of the Platform.
  10. User Data - all information provided by the User during registration and while using the Services available through the Platform.
General Provisions
  1. These Terms define the rules and conditions for providing Services through the Platform.
  2. The use of the Platform requires access to the internet and an electronic device equipped with a web browser that supports HTML, JavaScript, and Cookies.
Scope of Services
  1. By using the Services provided via the Platform, the User accepts these Terms and the Privacy Policy.
  2. Services are provided based on the content of these Terms and other documents that may regulate cases not described herein.
  3. The Administrator allows Users to use the following Services:
    1. Registering an Account;
    2. Creating and managing public Profiles;
    3. Browsing publicly available Profiles.
  4. The Services are free of charge and provided for an indefinite period.
  5. The Administrator reserves the right to temporarily suspend or permanently terminate the Services without prior notice in case of ceasing business activity related to the Services.
  6. The Services are provided "as is". The Administrator is not responsible for their accuracy, completeness, or fitness for a specific purpose.
User Rights and Responsibilities
  1. By creating an Account, the User confirms they have read and accepted these Terms.
  2. Each User may have only one Account on the Platform.
  3. The User may not share their login credentials with others or use another User's login credentials.
  4. The User is solely responsible for the accuracy of information published through their Profile.
  5. The User is obliged to use the Platform lawfully and ethically.
  6. It is prohibited to:
    1. Publish illegal content on the Platform;
    2. Share links to websites with illegal content;
    3. Perform actions that may disrupt the functioning of the Platform;
    4. Copy or extract data of other Users or parts of the Service using manual or automated means (e.g. web scraping).
  7. The Administrator grants Users a free, limited, non-exclusive, non-transferable license to use the Services solely for purposes consistent with the Platform's purpose.
  8. Users retain full ownership of the data submitted, processed, and stored within the Services.
Administrator Rights and Responsibilities
  1. The Administrator will take commercially reasonable measures to ensure proper and uninterrupted operation of the Platform.
  2. The Administrator determines the form and scope of Services and how they are offered to Users.
  3. The Administrator applies administrative, physical, and technical safeguards to protect internal networks and ensure privacy, confidentiality, and data integrity.
  4. The Administrator may license or sublicense the Services to third parties under the Terms.
  5. The User grants the Administrator a free, non-exclusive license to use User Data to deliver the Services. This license is valid until the Account is deleted.
  6. The Administrator may suspend or delete the User's Account for violations of the Terms.
  7. The Administrator may send the User messages to the email provided during registration regarding:
    1. Platform performance issues (upon discovery);
    2. Planned changes (at least 7 days in advance);
    3. Suggested improvements (no more than once every 3 months).
Liability
  1. The Administrator is not responsible for content published in Profiles by Users.
  2. The Administrator does not verify or guarantee the accuracy of information in User Profiles.
  3. The Administrator may introduce technical downtime and will notify Users in advance when possible.
  4. The Administrator is not responsible for security breaches caused by the User.
Intellectual Property
  1. The User declares that content in their Profile does not infringe third-party rights, including copyrights and personal rights.
  2. The Platform, its content, and Services are protected by intellectual property rights belonging to the Administrator.
  3. The Administrator automatically acquires rights to all analyses and reports created based on anonymized and aggregated User Data.
  4. The Platform's software is protected under copyright and database laws.
Term and Termination
  1. The Administrator may suspend or terminate Services at any time.
  2. Notice of suspension or termination will be sent to the User's email.
  3. In case of a Terms violation, the Administrator may suspend or delete the Account.
  4. The User is not entitled to compensation for service interruption or termination.
  5. Deleting an Account results in permanent deletion of User Data.
  6. Provisions regarding licenses, User Data, and liability remain effective after termination.
Limitation of Liability
  1. The Administrator is not liable for damages or loss of profit resulting from the use of the Services.
  2. The Administrator is not liable for damages due to discontinuation of the Services.
  3. The Administrator is not liable for failure to fulfill obligations due to force majeure (e.g. failures, wars, disasters).
  4. The Administrator does not provide recruitment services.
Personal Data Protection
  1. Data submitted by the User remains their property, even after their use of the Service ends.
  2. The Administrator acts as the data controller. The Privacy Policy is available at competenceprofile.com/privacy
Final Provisions
  1. These Terms are governed by Swiss law.
  2. Any disputes will be settled by the court in Zurich.
  3. The Administrator may change their name, legal form, contact details, or the nature of the Services, notifying Users via email. This does not constitute a change of the Terms.
  4. These Terms constitute the entire agreement between the parties and supersede prior arrangements. They may only be changed in writing and published at competenceprofile.com/terms with email notification to the User.
